PLN 4,806 Minimum Wage in 2026 and Work Legalization for Foreigners

Current rates from 1 January 2026
From 1 January 2026, the minimum wage is PLN 4,806 gross per month and the minimum hourly rate is PLN 31.40 gross. This represents an increase of PLN 140, i.e. 3.0% compared to 2025 (2025: PLN 4,666 / PLN 30.50 — Dz.U. 2024 item 1362; 2026: PLN 4,806 / PLN 31.40 — Dz.U. 2025 item 1242). The change directly affects work legalization conditions for foreigners (legal status as of August 2026).
Effect on work entrustment declarations
A work entrustment declaration must state a salary at least equal to the minimum wage. If a previously submitted declaration states a salary below PLN 4,806 gross, this may cause problems during Labour Inspectorate checks. In such a case, an annex to the contract is sufficient — raising the salary (including to the new minimum) does NOT require a new declaration or a new PLN 400 fee.
Effect on work permits
A work permit is issued for a specific position and salary. If the salary stated in the permit is below the current minimum, the employer is obliged to pay the worker at least the minimum rate. When filing new applications, always state a salary of ≥ PLN 4,806 gross.
Employer obligations
An employer hiring a foreigner cannot pay below the statutory minimum regardless of what the declaration or permit states. Non-compliance risks:
- A fine for violating minimum wage provisions
- Revocation of the work permit
- Refusal to issue further permits
