Current rates from 1 January 2026

From 1 January 2026, the minimum wage is PLN 4,806 gross per month and the minimum hourly rate is PLN 31.40 gross. The increase of over 5% compared to 2025 directly affects work legalization conditions for foreigners.

Effect on work entrustment declarations

A work entrustment declaration must state a salary at least equal to the minimum wage. If a previously submitted declaration states a salary below PLN 4,806 gross, this may cause problems during Labour Inspectorate checks. Employers should update employment conditions with an annex or a new declaration.

Effect on work permits

A work permit is issued for a specific position and salary. If the salary stated in the permit is below the current minimum, the employer is obliged to pay the worker at least the minimum rate. When filing new applications, always state a salary of ≥ PLN 4,806 gross.

Employer obligations

An employer hiring a foreigner cannot pay below the statutory minimum regardless of what the declaration or permit states. Non-compliance risks:

  • A fine for violating minimum wage provisions
  • Revocation of the work permit
  • Inclusion on the list of entities with restrictions on employing foreigners
